Types of Rental Contracts

1. Fixed-Term Contract

Fixed-term (Tijdelijk Contract) contracts are becoming increasingly common in the Dutch rental market. These contracts have a specified end date, after which the lease automatically terminates. Typically, these contracts range from six months to two years. This type of contract is reserved for specific types of situations and target groups.

2. Indefinite-Term Contract

An indefinite-term (Onbepaalde Tijd Contract) contract continues until either the tenant or the landlord decides to terminate it. This type of contract offers more stability and security for tenants, as they are not bound to a specific end date. With the recently entered “ Wet Betaalbaar Wonen” these type lease became the norm within the Netherlands.

3. Diplomatic Clause

This clause is included in rental contracts to allow expatriates to terminate the lease early if they are required to move due to work. It provides flexibility for those on temporary assignments.

1. Rent (Huurprijs)

The rent is the amount paid by the tenant to the landlord for the use of the property. In the Netherlands, rent can be regulated or liberalized, depending on the property’s points rating (woningwaarderingsstelsel).

Dutch law divides maintenance responsibilities between the landlord and the tenant. Generally, landlords are responsible for major repairs, while tenants handle minor repairs and upkeep.

2. Security Deposit (Borg)

A security deposit is typically one to two months' rent and is paid upfront. It serves as a financial guarantee for the landlord against any potential damages to the apartment.

5. Notice Period

The notice period is the amount of time required to terminate the contract. For indefinite-term contracts, tenants usually need to give one month’s notice, while landlords must give three months' notice when they terminate the lease.

3. Service Costs (Servicekosten)

Service costs cover additional expenses such as utilities, maintenance, and cleaning of common areas. These costs are usually detailed in the rental agreement and can vary.
